Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Apex Pro Timer website and application (the "Service"), provided by Steven Law, trading as Apex Pro Timer ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Apex Pro Timer is an interval-timer application for coaches and athletes that turns written programming into structured timers, with a free tier and an optional Pro subscription.

2. Eligibility and accounts

You must be of legal age in your jurisdiction to enter into a contract. You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity that occurs under your account.

3. Acceptable use

You must not:

  • Use the Service unlawfully, fraudulently, or for spam;
  • Infringe intellectual property or other rights;
  • Probe, scan, or interfere with the security or integrity of the Service;
  • Introduce malware or attempt to access accounts that are not yours;
  • Scrape, reverse engineer, or attempt to derive source code from the Service.

4. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan and these Terms.

5. Your content

You retain ownership of the timers, workouts, and other content you create. You grant us a limited licence to host, store, and process that content solely to provide the Service.

6. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing frequency, taxes, renewals, cancellations, and refund mechanics are governed by Paddle's Buyer Terms. Our own Refund Policy also applies.

Pro subscriptions renew automatically until cancelled. You can manage or cancel your subscription at any time via paddle.net.

7. Service availability

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Suspension and termination

We may suspend or terminate access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time by closing your account. On termination, your right to use the Service ends and we may delete your account data after a reasonable period.

9. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us (via Paddle) in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law (such as for fraud or personal injury caused by negligence).

10. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service in breach of these Terms, or your violation of applicable law.

11. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the seller's principal place of business, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer protection laws provide otherwise.
